This rental agreement is entered into by and between the renters, also referred to as Guest and RelaxCation Inc.: Louis and Aylene Nuth, hereinafter referred to as Owners.
1. AGREEMENT: The Celandine Unit 4028 is a private vacation home. The party listed above as the Guest agrees as follows: Guest is an adult over the age of 21 and will be the occupant of the unit during the entire reserved period and will be responsible for all other occupants not to exceed a total of 4 people. If occupancy exceeds 4 people, Guest and companions are subject to immediate removal and forfeiture of the security deposit and rental payment. Children must be under adult supervision at all times.
2. Security/Damage Deposit/Payment:
A security/damage deposit of Php1,000.00 is required for all vacation rentals. Guest understands that a signed copy of this agreement must be returned to the owners to complete reservation. Reservations booked through a third party, such as Airbnb, will not require an up-front deposit, but damage fee may be added at checkout. Damage/Security Deposit may be charged for items including, but not limited to the following: Any items in the home or part of the property be damaged; items missing like linens, towels, or beddings; excessive cleaning be required; if the home is left unsecure upon check out, excessive utility charges are incurred; smoking or contraband are found to be on the property during rental dates; and Guest or companions are evicted by local enforcement.
3. Cancelations: Cancelations must be made in writing or through the third party booking site. All cancelation received within seven (7) days of arrival will be non-refundable. Cancellations received within Fifteen (15) days of arrival will be refunded 50% of the total payment.
4. Subletting/Falsified Reservation: Guest is not authorized to let or sublet all or any part of the premises nor assign the rental to another party. The Guest shall occupy and use the premises as a vacation rental only, and not use the premises for any business, professional, unlawful, or hazardous purpose. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and rental money and the party will not be permitted to check-in.

5. Smoking. This is a non-smoking vacation rental. Evidence of smoking is enough basis to charge the renter for smoke clean-up.
6. Parties/Noise: Any illegal activity will result in eviction and forfeit of deposit. Any special occasions such as weddings, receptions, family reunions, or guest to exceed 4 people, including Guest must be disclosed at the time of reservation and subject to owner’s approval. Adults cannot rent the property on behalf of an underage guest. Noise should be kept to a level as to not disturb surrounding neighbors.
7. Checking-in is at 4:00pm unless prior approval is obtained from the owner. Please walk through the home upon check in and notify the owners immediately if there are any maintenance issues that need immediate attention.
8. Checking-out is at 11:00am unless prior arrangement with the owner is obtained. Ensure that the home is left in the same condition it was found, linens are stripped from beds and dishes are clean.
9. Repairs: Owners have, to the best of their ability, ensured that all items included in the rental property are in working order at the time of check-in. Should repairs be needed, the owner will attempt to repair the problem as soon as possible upon notice by the guest. Owners assumes no liability to tenant if such occur, as all products may require maintenance without notice.
10. Hold Harmless and Indemnity: Owners of rental property shall not be liable for any damages and/or injury to Guest and their visitors or their personal property due to Guest’s acts, actions, or neglect. Guest agree to hold harmless the owners against any claim for damage and/or injury due to the Guest’s act or neglect or their visitor’s acts or neglect. Persons using the pool and building amenities do so at their own risk and the owners assumes no responsibility for accident or injury. Children should never be left alone or allowed on decks without direct and constant adult supervision.
11. Child Proofing: Guest understands that no special efforts have been made to childproof the home.
12. Access/Entry of Premise: The Guest gives permission to an owner or owner’s representative, to enter the premise during reasonable daylight hours, without prior permission from Guest, but with prior notice if possible, for inventory and maintenance purposes and in case of emergency.
13. Weather/Acts of God: Owners are not responsible for any weather conditions or acts of God or nature that happen during the Guest’s stay. There will be no refunds made due to these causes.
14. Use of Security Cameras: Guest understand and accept that the property may be protected with outside cameras. There are no cameras inside the home.
15. Pets: There is an additional pet fee. No more than 2 pets, 50 kg per pet weight limit. No aggressive breeds. Pets must be declared at the time of reservation. At the sole discretion of the owners, animal that pose a health or safety risk, cause damage to property or are disruptive and not properly attended, may be asked to be removed from property. A leash is required when leaving the property. Guest assumes all liability for their pet and damage caused by their pet, including but not limited to additional cleaning or repair due to animal waste or damage.
16. Writing Exceptions: Any exceptions to the above-mentioned policies must be approved in writing in advance.
17. Survival: If any clause or term in this agreement is contrary to law, the remainder of the contract shall remain in full force.
