Hotels have the right to hold foreign guests accountable if they violate real-name registration requirements. This may include administrative penalties and civil compensation.
Real-Name Registration Requirements for Foreign Guests
Foreign guests (including foreigners and residents of Hong Kong, Macao, and Taiwan) must present valid identification documents when checking in, such as a passport or a residence permit for Hong Kong/Macao/Taiwan residents. The hotel must verify the document and register the guest's identity information.
If a foreign guest cannot provide valid identification, the hotel should assist them in verifying their identity with the public security authorities and upload the verified information to the public security management system within two hours.¹
Accountability for Violations of Real-Name Registration
Administrative Penalties
If a hotel fails to verify the identification documents of foreign guests or does not upload the required information in a timely manner, the public security authorities may impose penalties on the hotel or its staff in accordance with the Public Security Administration Punishments Law and the Exit and Entry Administration Law.
If a foreign guest refuses to cooperate with identity verification or provides false information, public security authorities may refuse to issue an accommodation certificate and may take additional management measures.
Civil Compensation
If a hotel fails to fulfill its real-name verification obligations and a foreign guest uses a false identity to commit illegal acts (such as secret filming or fraud), the hotel may bear supplementary compensation liability.
